Forge Application End User License Agreement (EULA)

This is a courtesy translation. In case of discrepancy, the Spanish version prevails, without prejudice to the mandatory rights of consumers.
This license governs the use of the Forge program that you install on your devices. It forms part of the General Terms and Conditions of Purchase and Use of Forge. Anything not covered here is governed by those terms.
1. Parties and acceptance
1.1. The license is granted by UNIMOVE RC SL, NIF B88207154, Avenida de los Andes 20, 28945 Fuenlabrada (Madrid), [email protected] ("the owner").
1.2. You accept it when you register and, in any case, when you install or use the application.
2. Purpose
We grant you a right to use the program. We do not sell you the program or any copy of it. All rights not expressly granted are reserved to the owner.
3. What you can do
3.1. Install and use Forge on the number of devices allowed by your plan.
3.2. Use it for your own analysis and to send orders to your own accounts.
3.3. The license is personal, non-exclusive, non-transferable and non-sublicensable. It lasts as long as you have an active account and, for Pro features, as long as your Pro plan is in force.
4. What you cannot do
Except where the law permits it and it cannot be excluded by contract (arts. 100 and 101 of the Texto Refundido de la Ley de Propiedad Intelectual (Spanish Consolidated Text of the Intellectual Property Act)), you may not:
- copy, modify, translate or create derivative works of the program;
- decompile, disassemble or reverse engineer it;
- remove or circumvent the code protection, the activation, the device limits or the license checks;
- sell, rent, lend, share or distribute the program or your access;
- use the program to provide services to third parties (for example, trading or displaying data for others) without written permission;
- use the program unlawfully or to manipulate markets.
5. Activation and devices
5.1. To use Forge you sign in with your account. The application registers the device (its name and a technical identifier) to enforce the device limit of your plan.
5.2. The application needs to connect periodically to our servers to check the license.
5.3. One session at a time. In addition to the device limit, each account can have only one session open at a time. If you open Forge on another device, the previous session is closed. Close your positions first or make sure you manage them by your alternative means (clause 10).
5.4. Access is yours alone. You may not share, assign, lend or sell your account, your credentials or your access, nor allow another person to use Forge with your account.
6. Updates
6.1. The application looks for and installs updates. Some may be necessary to keep using it or for security.
6.2. Do not install updates or restart Forge with open positions.
7. Technical diagnostic logs
7.1. The application keeps a technical operating log on your device and periodically sends a copy to our servers, associated with your account and your device, to provide support and fix errors.
7.2. That log may include: application and system version, device name, errors, connection events, user identifiers of your data or broker accounts, and order and session events. It does not include passwords.
7.3. How we process it, how long we keep it and how to object are explained in the privacy policy.
8. Third-party components
The program includes open-source or other third-party components with their own licenses. The list and their notices are in the application, under "About". Those licenses prevail for those components.
8 bis. Suggestions
If you send us ideas, suggestions or comments about Forge, we may use them to improve the product at no cost and without obligation to you. We will not use your name without your permission. This does not affect your personal data, which is processed in accordance with the privacy policy.
9. Order panel
9.1. The order panel sends to your broker account the orders that you click. Forge does not decide orders, does not execute them and does not guarantee their execution.
9.2. By activating it you accept clause 13 of the Terms of use.
10. Alternative means (contingency)
While you use Forge, and especially the order panel, you keep your broker's or provider's platform open and operational and/or you have at hand the phone number of your broker's trading desk. Forge is not your contingency software. You supervise your orders and positions, and what counts is what your broker says. The details are in clause 13 of the Terms.
11. Warranty
11.1. If you are a consumer, you have the statutory guarantee of conformity of digital content and services. This license does not limit it.
11.2. Apart from that statutory guarantee, and to the extent permitted by law, the program is provided as is. Beta versions and the Free plan may have errors and change without notice.
12. Liability
Clause 17 of the Terms applies, with all its exceptions: our liability is not limited for wilful misconduct, gross negligence, personal injury, defective products or in any case where the law does not allow it.
13. Termination
13.1. The license terminates if you close your account, if it is closed for serious breach or if the service ends.
13.2. Upon termination, you must stop using the program and may uninstall it. Pro features cease to be available when your Pro plan ends.
14. Governing law, courts and language
Clauses 24 and 25 of the Terms apply. The Spanish version prevails.
